This Website Privacy Policy (“Privacy Policy” or “Policy”) describes our practices in connection with the information that we may collect through your use of this website (“Site”).

In the course of normal operations Elevate may collect information about you that, alone or in combination, could be used to identify you or your device (“personal information”) in one or more of the following ways.

Collection of personal information may include but not be limited to one of the following methods: (a) Public Information (Information that is already publicly available, Information received through or by social media mechanisms, or Information requested through or by social media mechanisms), (b) Voluntary submission of personal information (Use of our website, Submission for the request for additional information through email, phone call or form on our website, Accepting the use of cookies and the use of the website, Registration for an event, Application for employment and other related documents), (c) Normal operations and internal personal information processing activities (Employment, Information required to complete a transaction, purchase, or provide services, Delivery of services / online services, Various contracts as required).

Consent and Legal Processing of Personal Information:

By voluntarily accessing our website, applications, services, or information provided to you by Elevate you acknowledge that such access or personal information is requested by you and that you are providing the requested personal information voluntarily.

We reserve the right to deny access to or provide any such services or information, where you decline to provide requested personal information, if such consent is required by law in your country of residence for Elevate to process or transfer the necessary personal information. By voluntarily disclosing your personal information on our web site or to an employee, you will be deemed to have granted your consent to the mutually beneficial uses reasonably contemplated at the time of your consent, including ordinary data processing activities by any third parties on our behalf, to the extent such consent is legally sufficient in your country of residence.

Elevate uses your personal information to better understand your needs and provide you with better service. Specifically, we use your personal information to update you on the benefits and features of working with or for Elevate and to provide you with information and material requested by you. We may collect personal information when Users communicate with User support services. ​By using these Service, you are authorizing us to gather, parse, and retain data related to the provision of the Service. We may use and retain data we collect to provide and improve our services. ​We may anonymize, and aggregate data collected pursuant to the Agreement and use it for the purposes of providing Services under the Agreement and to improve our Services. 

We will never: (a) rent or sell any personal information to third parties, (b) share personal information with third parties for the purpose of targeted advertising, (c) use personal information for marketing purposes, or (d) claim ownership of your personal information. 

If you fail to provide certain personal information when requested, we may not be able to perform the contract or provide the services that we have entered into with you (such as paying you or providing a benefit), or we may be prevented from complying with our legal obligations.

We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so. NOTE – Elevate may process your personal information without your knowledge or consent where this is required or permitted by law.

Elevate may have to share your personal information with third parties, including third-party service providers and other entities. We will take reasonable and appropriate steps to ensure that the third parties respect the security of your personal information, treat it in accordance with all applicable laws, and use it only for the specific purpose that it was provided.

It is not the objective or intent of Elevate to seek any sensitive personal information through our web site. Sensitive personal information may include several types of data relating to; race or ethnic origin; political opinions; religious or other similar beliefs; trade union membership; physical or mental health; sexual life or criminal record. We suggest that you do not provide sensitive personal information of this nature, unless as part of an employment application or your employment. If you elect to provide sensitive personal information not requested by Elevate, you expressly provide consent to Elevate for the use of that personal information consistent with the mutually beneficial uses reasonably contemplated at the time of your consent or as more specifically described at the point where you choose to disclose your personal information.

Elevate does not assume responsibility for verifying the personal information you submit, or for establishing the ongoing accuracy of the content of the personal information. If Elevate is informed that any personal information collected through a web site is no longer accurate, we will make appropriate corrections based on the updated information provided by the authenticated visitor.

Legally Compelled Disclosure:

Despite our commitment to protecting your personal information, there may be circumstances under which we may be deemed to be legally compelled to access, preserve, or disclose your personal information. These circumstances may include, among others: (a) Situations where disclosure is required by law, or necessary to comply with an order of a court or governmental agency, or necessary for matters of safety and security, (b) In response to lawful requests by public authorities, including to meet national security or law enforcement requirements, and (c) In such cases, Elevate will make good faith efforts to provide only that personal information which is the subject of the official order or request.

Cookies and Internet Tags:

 We may collect and process information, such as anonymous usage statistics, by using “cookies,” server logs, and other similar technology as you use the Service in order to help us improve the Services and to compile aggregate statistics about the use of Services for internal purposes. Cookies enable you to sign in to the Service and access your stored preferences and settings. If you choose to block this function, it may impair required functionality and therefore your use of the Services. 

Data Retention:

Elevate will only retain your personal information for as long as necessary to fulfill the purposes that we collected it for. This also includes satisfying any applicable legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of the personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. In some circumstances we may anonymize your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you. Additionally, once you are no longer an employee or worker of Elevate, we will retain and/or securely destroy your personal information in accordance with our data retention policy and/or applicable laws and regulations.

You will not have to pay a fee to access your personal information (or to exercise any of the other rights defined within this Policy). However, we may charge a reasonable fee if your request for access is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access the personal information (or to exercise any of your other rights). This is an appropriate security measure to ensure that personal information is not disclosed to any person or entity that has no right to receive it.

Elevate does not endorse or make any representations about them, or any information, software or other products or materials found there, or any results that may be obtained from using them. When you link to other web sites, the Elevate Privacy Policies no longer apply, and we assume no responsibility for the information or other practices of a site that is accessible through ours. Student Data Privacy Policy

At EDBLOX, Inc., d.b.a. Elevate (“Elevate,” “we,” “us,” “our”), we understand that you care about the privacy of you and your family’s data.  We take your privacy seriously.  This Privacy Policy (“Privacy Policy” or “policy”) describes how we handle data and personal information in providing Elevate’s services (“Services”) to its users and customers. All of Elevate’s systems, procedures, use of data, and Services are in accordance with the Family Education Rights and Privacy Act of 1974 (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99) governing the use of student data. We may, from time to time, update this policy to address new issues or reflect changes to our Services. Please review this Privacy Policy periodically. In the event we make changes that are material to the use of personally identifiable information, then we will attempt to provide you with notice of those changes. We reserve the right to revise this policy, with such revisions effective immediately upon the posting of the revised policy. Your use of Services after such posting constitutes your acceptance of those terms as revised. ​

Definitions: 

Capitalized terms not defined in this Definitions section below shall have the meaning set forth by applicable law when a citation is present. ​

“Agreement” means the underlying Service Agreement and related agreements between Elevate and the School.  

“Services” means Elevate’s live streaming educational instruction services as provided to Schools, which include, but are not limited to providing virtual student instruction, feedback, and K-12 educational content. 

“School” means the local education institution, school, or school district that has purchased and is using Services pursuant to an Agreement with Elevate. 

“Student Data” means the personally identifiable information Elevate receives regarding a student of a School. 

“User” means an authenticated user of Elevate’s applications, products, websites, and services. 

Student Data Collected: 

Elevate receives Student Data from Schools and Users in order to provide Services under its Agreement with the School. Elevate receives personally identifiable information such as a student’s first and last name, through information provided by the User. ​

Elevate collects Student Data and User personally identifiable information from the School. 

Elevate uses Student Data for educational purposes, to provide Services pursuant to an Agreement, to improve our education Services, for purposes requested by the School, as permitted by applicable law, for customer support, to enforce access and security controls, to conduct system audits.

Student Data we collect and store from the School includes, but is not limited to the student’s and or User’s: ​​

  • First and last name 
  • Grade level (for example: sixth grade, seventh grade, etc.) 
  • User-generated content ​
  • Student generated content, school records, such as attendance, grades, assessments, and Individual Education Plan status, teacher comment and feedback

Student Data Disclosed: 

Elevate discloses Student Data to third parties solely for the purposes of providing Services pursuant to an Agreement, as directed by the School, or as required by law. Student Data is disclosed under the following circumstances:

  • To Users of the School authorized to access such Student Data for the provision of Services.
  • To Elevate’s service providers, subprocessors, or vendors with a legitimate need to access such Student Data in order to provide Services under the Agreement.
  • As permitted by applicable law, in responses to legal requests or pursuant to government proceedings
  • To Elevate’s successor entity in the event of a merger or acquisition by another entity, provided that the successor entity will follow the same commitments as provided in this Privacy Policy, and will adhere to standards no less stringent than industry standards and those required by FERPA in order to continue to use or maintain Student Data. Elevate will provide the School with notice of such change of control and an opportunity to opt in to a successor entity’s use of Student Data or to exercise its option to delete or de-identify such data pursuant to written request.

User Information Collected: 

Users provide us with information through the Services. This information may include, but is not limited to, personal information such as your first and last name, User login credentials, email address, phone number, profile picture, address, school district affiliation, and any other information necessary to provide Services. ​

Cookies and Internet Tags. We may collect and process information, such as anonymous usage statistics, by using “cookies,” server logs, and other similar technology as you use the Service in order to help us improve the Services and to compile aggregate statistics about the use of Services for internal purposes. Cookies enable you to sign in to the Service and access your stored preferences and settings. If you choose to block this function, it may impair required functionality and therefore your use of the Services. ​

User Support. We may collect Student Data and personally identifiable information when Users communicate with User support services. ​

By using the Service, you are authorizing us to gather, parse, and retain data related to the provision of the Service. ​

Internal and Service-Related Usage. We use information, including Student Data, for internal and service-related purposes and may provide it to third parties to allow us to facilitate the Service. We may use and retain data we collect to provide and improve our services. ​

Aggregate Data. We may anonymize and aggregate data collected pursuant to the Agreement and use it for the purposes of providing Services under the Agreement and to improve our Services. 

We Use Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of the Service. We may share information, including Student Data, with our third-party transportation providers as necessary to provide the Service. If we transfer personal information to a third party, we will take reasonable and appropriate steps to ensure that the third party collects, processes and discloses personal information only for limited and specified purposes in order to provide Services under the Agreement. 

No Marketing or Ownership of Student Data and User Data. We will never: 1) rent or sell any Student Data or User personally identifiable information to third parties; 2) share Student Data or User personally identifiable information with third parties for the purpose of targeted advertising; 3) use Student Data or User personally identifiable information for marketing purposes; 4) claim ownership of Student Data or User personally identifiable information. ​

As Required by Law and Similar Disclosures. We may access, preserve, and disclose Student Data if we believe doing so is required or permitted by law or appropriate to: comply with law enforcement requests and legal process, such as a court order or subpoena or to meet national security requirements; respond to your requests; or protect yours’, ours’ or others’ rights, property, or safety. ​

Security of Student Data

We take steps to ensure that Student Data is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information provided to us. ​

Elevate stores and processes Student Data in accordance with industry standards and applicable law. In this regard, Elevate ensures Student Data is protected from unauthorized access, use, and disclosure. In the event that Elevate learns that the security of Student Data has been compromised, Elevate will notify you pursuant to the terms of the Agreement and as required by applicable law. Elevate will attempt to notify you as promptly as possible under the circumstances of any security breach affecting Student Data that Elevate believes may pose a material risk of harm. ​

If Elevate receives notice from a School to delete or destroy Student Data, we will take steps to make sure that the deletion of Student Data complies with FERPA standards. ​

To protect Student Data, Elevate maintains an information security program that implements appropriate physical, administrative, and technical safeguards. Elevate conducts risk assessments of its information security program and remediates potential security vulnerabilities if identified.​

Student Data is stored on servers within the United States.

Subprocessors, service providers, third parties or vendors engaged in providing Services pursuant to an Agreement are bound by written agreement to standards that are no less stringent than industry standards for the handling and treatment of Student Data and personally identifiable information as defined under FERPA.

COPPA: 

Our Services comply with all applicable provisions of the Children’s Online Privacy Protection Act (COPPA) (15 U.S.C. 6501 et seq.). To the extent COPPA applies to the information we collect, we process such information for educational purposes only, at the direction of the partnering School and on the basis of educational institutional consent. ​

CCPA: 

The Services we provide to our Customers comply with all applicable provisions of the California Consumer Protection Act (CCPA) (§1798.100 et seq.) The information we collect is solely for the delivery of our Services and is not sold to any third parties. It is our objective to ensure any personally identifiable information we have about our customers is accurate and necessary to provide our Services.​

To the extent CCPA applies to information we collect about individual California consumers, it is your right under CCPA to, access, rectify, object to, request erasure, export or choose how we process any personally identifiable information collected for the delivery of our services at any time. If you are a student or parent of a student at an educational institution using our products and wish to exercise any of these rights, please direct any requests to the appropriate representative at your educational institution. For any other Customers to whom we have sold our products to directly (not an educational institution), you can exercise your rights to pose questions, comments, or concerns by emailing [email protected].​
